Present the "NTA"The NTA is the "Notice to Appear" or notice to appear before the court, as the demand for deportation. Any civil suit (not criminal) is an opportunity to answer the allegations. Bond HearingIn the U.S., the bond is not a fine, its a deposit delivered to the court to ensure your appearance with the court and comply with all orders of the judge. Everyone is entitled to ask for a bond except for those with previous deportations or certain crimes. "Master" HearingThis is a hearing to answer the allegations in the NTA that the judge will give his ruling on two main topics: (1) the defendant is an immigrant who may be removed by the government? and (2) there is a remedy that could apply for an immigrant? The Individual HearingThis is a hearing on whether the immigrant can show if they are eligible for the relief requested. Traditional RemediesAdjustment of StatusIf you are eligible to adjust your residency status a request to end the deportation case is presented. Cancellation of RemovalHas 4 elements: (1) 10 years in the country, (2) citizen or resident to immediate relative (parent / child / spouse), (3) prove extreme hardship to relatives if removed from the U.S, (4) good moral character/non-immigration crimes. Motion to TerminateCan be asked if there was a violation of your constitutional rights, or if you can ask for humanitarian clemency with the Immigration Service. To Request a WaiverResidents or eligible to apply for adjustment of status with immigration with prior offenses or other stains are sometimes eligible to apply for a pardon before the judge. The U VisaFor those victims of crimes who cooperate with authorities are eligible to apply for the “U” Visa and stop the deportation. |
