H2-A, or agricultural visas, are available to workers to come to the United States temporarily to work. The U.S. Department of Agricultural determines the number of H2-A visas available, based on the projected shortage of U.S. agricultural workers in any given year.

H2-A Visa Requirements — Employer

Before requesting non-U.S. citizen workers, the employer must have actively sought help from within the United States. This may include advertising for the position through radio and newspaper ads, etc. If no U.S. workers are qualified or willing to take the position, the employer can proceed with seeking non-U.S. citizen help, if the following requirements are met:

  • The duration of the job must be less than one year.
  • The employer must offer the worker temporary but steady employment for at least three-fourths of the days of the employment contract.
  • The employer must pay the worker the same amount as he or she would pay a U.S. citizen worker, and this amount must be at least the state or federal minimum wage.

H2-A Visa Requirements — Employees

In order to be eligible for an H2-A visa:

  • The employee must have received a job offer from the employer. The employer must have been eligible to host H2-A visa workers.
  • The employee must return to his or her home country following the term limit of the H2-A visa.
